Description

Bankruptcy reorganization is becoming increasingly common in Sweden. However, every other reorganization fails. This imposes significant financial burdens on entities such as banks and suppliers. Traditionally, Bankruptcy reorganization has been approached from a legal perspective. This includes the initial viability test, which aims to ensure that courts admit the right companies to the reorganization process. However, the legal perspective provides a too narrow view of what constitutes a viable company. The purpose of the project is to further develop the viability test. This is achieved by combining legal science and methods with management research on business relationships. The study also contributes to theory development in both law and management.
