Intellectual property (IP) management with UU RIP AB

In collaborations with companies or foreign universities, agreements are entered into to regulate intellectual property (IP) rights. IP rights normally go to the originator at the University in accordance with “professor's privilege”. To make it possible for the University to enter into this type of research collaboration, there must be internal management of IP ownership. One way to manage IP is to utilise Uppsala University Research Intellectual Property AB (UU RIPAB).

Sweden is one of the few countries in the world where academic researchers own the rights to their results, unless other agreements have been made. This so-called “professor's privilege” makes it possible for you to create additional value for your research e.g. by patenting and commercialising the results in your own company, through licensing, or through other types of knowledge transfer.

In some situations, it may be problematic for the researcher to have ownership rights to their IP. One example is research collaborations where the funder or another partner requires all parties to be legal persons or where there is a requirement for the University to manage IP that arises in its part of the project. This may be the case in consortiums with industry and/or other universities, which require the signing of agreements governing IP. For legal reasons, it is not appropriate for the University to take over ownership rights from the researcher. An alternative is that you, as researcher, instead temporarily sign off your IP ownership to the University’s management company, Uppsala University Research Intellectual Property AB (UU RIP AB), in order to make it possible to participate in the collaboration.

Make a utilisation budget

For a researcher, it is important to consider budgeting for the costs of UU RIP AB’s services as early as the application stage. Costs can be taken up as patent applications, patent consultants, patent monitoring and market analyses, etc. A tip is to figure in about 3 percent of the total budget.

UU RIP AB is a wholly-owned subsidiary of the University’s holding company established specifically to be able to act as IP owner or manager in cases where it is not appropriate for the researcher to do so. UU RIP AB manages IP until such time as it can be transferred back to you as participating researcher, transferred to a collaborative partner, or otherwise provided in connection with a research project. UU RIP AB takes no part of any revenue from the sale or licensing of the researcher’s IP, but does charge a fee equal to the costs incurred for administration. To be able to use UU RIP AB, the research project must therefore have full cost recovery for UU RIP AB.

Even smaller, national projects can benefit from using RIP AB´s services. For example, the Swedish foundation for strategic research, SSF frequently reserves a small part of their research grants to fund patent costs, and these funds can be requisitioned through RIP AB.

Robust support for commercialisation and other utilisation

For researchers and other employees who wish to commercialise or otherwise utilise their ideas and results, the University offers support through their innovation office, UU Innovation, and their holding company, UU Holding AB. As an example, UU Innovation can provide free support in investigating patentability, applying for a patent and evaluating commercial conditions. UU Holding can invest in development projects and new companies at an early stage to help them reach the market.
